EU ban on the destruction of unsold goods

The regulation applies to textiles, clothing, accessories, and footwear, and serves as a blueprint for other consumer goods. It is based on the ESPR and will become legally binding from 19th of July 2026.

Together with the new EU Ecodesign Regulation and the national duty of care under Section 52a of the German Circular Economy Act (KrWG), this is a definitive move against the waste of valuable resources. Unsold goods and returns are not waste, but assets whose value must be retained and recovered.

FAQ: Compliance and market protection

In most cases, no.
Destroying usable new goods goes against the duty of care under §52a KrWG, with additional bans applying to certain categories such as textiles.

ReValue provides a compliant alternative to destruction.

The ban is part of the Ecodesign for Sustainable Products Regulation (ESPR) and targets the destruction of usable consumer goods, particularly from returns and excess inventory.

It prohibits destroying unsold items that remain suitable for use, including goods that were never sold or were returned by customers.

The first phase focuses on textiles, footwear, and accessories. From July 2026, after a two-year transition period, the ban will apply to large companies in these sectors.

The regulation is likely to extend further, with the EU Commission able to include additional product categories such as electronics.

Whether your company is affected, how and when, depends mainly on your size and product range. The EU has introduced a phased rollout:
 

Which category does our company fall into?
 

  • Large companies (more than 250 employees): The ban on destroying textiles, clothing, and footwear applies from 19 July 2026.
     
  • Medium-sized companies (50 to 249 employees): You benefit from a transition period, with full compliance required from 19 July 2030.
     
  • There is also a reputational risk to consider, as transparency reports will be publicly available to customers and environmental organizations.

Beyond regulatory consequences, there is a reputational risk stemming from growing public scrutiny around the destruction of goods.
